Home loan guarantor

Going guarantor on a home loan? Get advice before you sign.

If you’re guaranteeing a family member’s mortgage, your lender will require you to get independent legal advice first. We provide it online, Australia-wide, usually the same day — and issue your certificate that day.

What this is

The step between you and settlement.

Guaranteeing a home loan is one of the most significant financial commitments a person can make — and often it’s made for someone you love. Parents go guarantor so their children can buy a first home. A spouse or partner signs to support a purchase. Family members step in when a deposit falls short.

Because a guarantor promises to repay a loan they typically don’t benefit from, Australian lenders almost always require you to obtain independent legal advice before they release funds. The advice makes sure you understand what you’re agreeing to, and the certificate we issue is the lender’s proof that you did.

Without it, settlement doesn’t happen. With us, it’s a short video appointment — often the same day you book — with a lawyer who has spent his career in banking and finance, not a rushed meeting squeezed into a solicitor’s diary a fortnight away.

What we do in your appointment

  • Review your loan offer, guarantee and any mortgage over your property;
  • Explain, in plain language, exactly what you’re promising and what it could cost you;
  • Walk through the specific risks to you and your home;
  • Answer every question until you’re comfortable; and
  • Issue your signed independent legal advice certificate, sent wherever you direct.

Understand the risk

What guaranteeing a home loan really means.

01

You owe the whole debt

If the borrower can’t pay, the lender can pursue you for the full outstanding balance — not just a share of it.

02

Your home can be at risk

Where your own property secures the guarantee, the lender may ultimately be able to force its sale to recover the debt.

03

It’s not your loan

You take on the liability without receiving the loan money — a mismatch that makes understanding the terms essential.

04

It can last for years

A guarantee can bind you for the life of the loan, and may affect your own future borrowing capacity.

Common questions

Home loan guarantor questions.

Why does the bank make me do this?

Lenders require independent legal advice so they can show that you understood the guarantee when you signed it. It protects them from a later argument that the commitment wasn’t properly explained — and it protects you by making sure you go in with your eyes open.

Can both my partner and I be seen together?

Each guarantor must receive advice independently, so we meet with you separately. You’re welcome to book back-to-back appointments on the same day.

What do I need to have ready?

Your loan offer and guarantee documents (your broker can usually send one PDF), photo identification, and a private space with a phone or computer camera for about 45 minutes.

How fast can I get my certificate?

Usually the same day. Book before midday with your documents ready, and we can generally meet and issue your certificate that afternoon.

Which lenders do you cover?

We provide advice for guarantors across all major Australian banks and lenders. If your lender has a specific certificate template or witnessing requirement, tell us when you book and we’ll confirm what’s needed.
