Agreement to these terms
These Terms of Use govern your access to and use of this website and the services offered through it by LW Williams and Associates (“we”, “us”, “our”). By using the site or making a booking, you agree to these terms. If you do not agree, please do not use the site.
About our service
We provide independent legal advice to personal guarantors and issue independent legal advice certificates, delivered by video appointment. Our fixed fee and the scope of what is included are set out on our website at the time of booking.
When a lawyer–client relationship begins
Using this website does not create a lawyer–client relationship. That relationship begins only once we confirm your booking, complete our identity and conflict checks, and you accept our engagement. Information on this website is general in nature and is not legal advice for your circumstances.
Eligibility
You must be at least 18 years old and able to enter a binding agreement to use our services. The advice is provided to you personally as the guarantor named in the loan documents.
Bookings and fees
Our fee is $595 including GST, per guarantor. The fee covers a review of your documents, your video appointment, the signed independent legal advice certificate, and delivery of that certificate as you direct. Where more than one person is guaranteeing a loan, each person requires separate advice and a separate fee. Payment is due at the time of booking.
Cancellations and refunds
If you need to cancel or reschedule, please contact us as soon as possible and we will do our best to accommodate you. Whether a fee is refundable depends on the circumstances and how much notice you give. Nothing in this clause limits any rights you have under the Australian Consumer Law, including the consumer guarantees, which cannot be excluded.
Your responsibilities
To provide the advice, we rely on you to:
- give us accurate, complete and current information;
- provide the correct loan, mortgage and guarantee documents;
- complete the identity verification process; and
- attend your appointment at the booked time.
We are not responsible for consequences arising from information or documents that are incomplete, incorrect, or provided late.
Scope of the advice
Our advice is limited to the independent legal advice required in connection with your guarantee, and the documents you provide. It does not extend to financial or taxation advice, the merits of the underlying loan, conveyancing, or any other matter unless separately agreed in writing. We do not advise the borrower or the lender.
Website content
Information on this website is provided in good faith and for general information only. We take care to keep it accurate but do not warrant that it is complete or current, and it should not be relied on as a substitute for advice specific to your situation.
Intellectual property
All content on this website — text, graphics, logos and design — is owned by us or our licensors and is protected by law. You may view and print it for your own personal use, but you may not reproduce, distribute or use it commercially without our written permission.
Liability
To the extent permitted by law, our liability for the services is limited as set out in our engagement terms. Our liability is limited by a scheme approved under Professional Standards Legislation. Nothing in these terms excludes, restricts or modifies any consumer guarantee or other right you have under the Australian Consumer Law that cannot lawfully be excluded.
Privacy
We handle your personal information in accordance with our Privacy Policy, which forms part of these terms.
Governing law
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
